Plea Against Release of Prof. Saibaba – Special Saturday Hearing at Supreme Court – Live Updates


The Supreme Court is hearing the state of Maharashtra’s plea challenging the Bombay High Court’s order acquitting former Delhi University professor GN Saibaba and five others in a case of alleged links to the Maoists.

On Friday, the Bombay High Court had allowed their appeals against the conviction and life sentence handed down under the UAPA Anti-Terrorism Act. On the same day, in the evening, the SLP attacking the said order was mentioned before the bench consisting of Judges DY Chandrachud and Hima Kohli by the Solicitor General, Mr. Tushar Mehta for early registration. He has orally applied for a stay of order from the Bombay High Court in the meantime. Reluctant to grant a stay of execution of an order of acquittal, the Chamber, at the request of the SG, granted him freedom to file a motion for an administrative decision of the ICJ, with Judge UU Lalit scheduled to enter the case on Saturday ( today).

While acquitting the respondents here, the Bombay High Court ruled that the suit was null and void as the valid sanction required under Section 45 of the UAPA had not been obtained. The Court observed that procedural guarantees cannot be sacrificed on the altar of a “perceived danger to national security”.
